CGM PILATES TERMS AND CONDITIONS

Welcome to CGM Pilates. Please read our Terms and Conditions carefully.

Prior to entering our studio we require you to agree to our Terms and Conditions.

Definitions

1. In these Terms and Conditions, we use the following definitions:

a. “CGM Pilates” “us”, “we”, “our”, all mean CGM Body Pty Ltd (ACN 616 940 393)

b. “Representatives” means CGM Pilates directors, officers, contractors, employees, consultants, partners, advisors or other affiliates.

c. “Terms and Conditions” means the terms and conditions set forth in this document and forming the agreement between us and you.

d. “Member” means a person with a Membership.

e. “Membership” means a membership granted by us to a person in order to have access to the Studio and Classes.

f. “Studio” means the physical premises operated by CGM Pilates.

g. “Services” means Pilates and associated services provided by us.

h. “Class” means a physical exercise class held at the Studio which provides Pilates or fitness instruction.

i. “Class Schedule” means, a schedule for the conducting of Classes implemented by us from time to time.

j. “you” means you, a person who either:

i. Has a valid and current Membership; or

ii. Enters the Studio, regardless of any Membership status.

Application of Terms & Conditions

2. By obtaining a Membership or otherwise physically entering our Studio, you agree to be bound by the Terms and Conditions.

3. The Terms and Conditions will be displayed online on our website, located at www.cgmpilates.com. You may request a physical copy at the reception desk of our Studio.

4. These Terms and Conditions can be amended by CGM Pilates at any time. We will notify you in writing of any changes to the Terms and Conditions by e-mail, on our website or otherwise at our Studio. You should familiarise yourself with these Terms and Conditions and check for updates regularly.

Contact Details and Privacy

5. CGM Pilates' uses a third party client management software known as “Mindbody Online”. In order to create a Student Membership, your personal information will be provided to the proprietor of Mindbody Online. The collection and use of personal information by Mindbody Online is governed by Mindbody Online’s privacy policy, which can be viewed here.

6. You must inform us when your contact details change so we can keep in touch with you.

7. CGM Pilates complies with the Privacy Act. We take the protection of your personal information seriously. Our full privacy policy can be found here. If you have any questions about our Privacy Policy, or if you wish to request access to your personal information, correct or update your details or raise any privacy concerns you may have, please contact us at info@cgmpilates.com.

General Conditions of Entry

8. CGM Pilates’ Owners or Instructors shall have the right to restrict members and all other persons to a particular type of Class for safety reasons and shall have the right to turn you away if you do not have the correct medical clearance.

9. Every possible effort is made to hold our Classes as advertised. However, the Class Schedule is subject to change and/or cancellation without any notice.

10. Out of respect to your Instructor, other clients, and also for your safety, late entry into Class will not be permitted.

11. CGM Pilates is not responsible for the safekeeping of your belongings. We encourage you to leave all valuable items at home and only bring what is necessary into the Studio.

12. All instructors at CGM Pilates are qualified Pilates instructors. We strongly recommend that you pay close attention to the direction provided by an instructor during any of our Classes to ensure that your risk of injury or discomfort while participating in a Class is reduced.

13. (a) Members are advised to seek medical advice prior to commencing any exercise program if they are in any doubt about their ability to engage in exercise. Your participation in any form of exercise at our Studio is done entirely at your own risk.

      (b) If you are new to Reformer Pilates Class you must attend an introduction session. One of CGM Pilates’ friendly staff will discuss your goals and introduce you to the foundations of Pilates and the reformer machine. At the end of your introduction session CGM Pilates will recommend what Classes are suitable for you to attend.

14. You must inform us and any instructors if there are any risks to your health by participating in Pilates practice, including in a Class, such as if you have a pre-existing injury, illness, muscle soreness/discomfort or are pregnant, prior to commencement (a “Medical Condition”). Where you have a Medical Condition, we strongly recommend that you seek approval from a medical practitioner to participate in any of our Classes. Your participation in any form of exercise at our Studio with a Medical Condition is done entirely at your own risk.

15. Members are required to wear appropriate attire for physical exercise at all times while visiting our Studio, and must refrain from wearing clothes which contain offensive prints or designs.

16. Members are required to conduct themselves within a Class in a manner which is respectable and considerate to other Members attending the Class. Members must not behave in an anti-social, intoxicated, disorderly, aggressive, offensive or dangerous manner or in any manner which may threaten the security of other Members or other people at the Studio.

17. Smoking is prohibited inside and out the front of our Studio at all times.

18. All purchases are final and CGM Pilates shall be under no obligation to make refunds on services for change of mind, user error, injury, illness, change of address or any other reason.

19. All Class passes and Memberships are non-transferable. Passes and Memberships are granted to you personally and may not be shared.

CGM Pilates Group Class Cancellation Policy

20. You can freely cancel a group class up to four (4) hours prior to the commencement of the class. If you cancel a class with less notice than four (4) hours notice it will count as ‘Late Cancellation’. If you do not turn up for a booked class and do not cancel your booking this counts as a ‘No Show’.

21. We understand that sometimes unforeseeable circumstances can arise, however we have to be strict, fair and consistent with all clients and therefore NO exceptions will be made.

22. Late cancellations and/or No Show's will incur a lost session and/or a penalty fee

(a) For clients on a pre-paid Membership who late cancel, a $5 Late Cancel Fee will be automatically deducted from your nominated account. Fees are processed within 48hrs of the cancellation.

(b) For clients on a pre-paid Membership if you do not show up for a booked class and do not give us any notice you will be charged a $10 'No Show Fee' which will be automatically deducted from your nominated account. Fees are processed within 48hrs of the no show.

(c) For clients on the 2 WEEK INTRO PASS,  if you do not turn up for a booked class, you will loose 1 day off your 2 week intro pass.

CGM Pilates Appointment Cancellation Policy

24. You can freely cancel a massage or private Pilates appointment up to twenty-four (24) hours to the commencement of the appointment, and up to four (4) hours for an infrared sauna booking. If you cancel outside of these windows it will count as ‘Late Cancellation’. If you do not turn up for a booked appointment and do not cancel your booking this counts as a ‘No Show’.

25. We understand that sometimes unforeseeable circumstances can arise, however we have to be strict, fair and consistent with all clients and therefore NO exceptions will be made.

(a) Late cancellations will incur a fee of 50% the cost of a full price casual appointment which will be charged to your credit card on file

(b ) If you No Show for a booked appointment, then you will lose one of your pre-paid sessions from your account. If your booking is unpaid you will be charged full price for the appointment at the casual rate.

Our Liability

27. You acknowledge and agree that CGM Pilates and our Representatives shall not be liable for any injury, illness, accident, loss or damage of any kind whatsoever suffered by you either directly or indirectly in connection with your attendance at or entering the Studio or participation in a Class or as a consequence of your Membership and you release CGM Pilates and its Representatives absolutely from any and all claims in connection therewith.

Indemnity

28. You shall indemnify and keep indemnified CGM Pilates and our Representatives in respect of all loss or damage suffered by us or our Representatives as a consequence of any breach by you of these Terms and Conditions.

Intellectual Property

29. You acknowledge and agree that our intellectual property includes but is not limited to our name, logos, brands, teaching manuals and methods, instructions manuals, website design and promotional materials whether in printed or digital form, and you further acknowledge and agree that you will not deal with our intellectual property in any manner whatsoever without first obtaining our prior written consent.

Refund/Transfer Policy

30. CGM Pilates reserves the right to charge an administration fee of $5.50 for any refunds or transfers requested.

General

31. Any unenforceable or void provision, or part thereof, may be severed from these Terms and Conditions without affecting the validity of the remaining provisions.

32. These Terms and Conditions shall be governed by the laws of Queensland, and the parties shall submit to the authority of the Courts of Queensland
